General terms and conditions
Last updated: October 2026. This is a translation; in case of discrepancies, the German version prevails.
1. Scope
These general terms and conditions apply to all orders placed in the online shop mahwear.ch. Your contractual partner is:

The version in force at the time of the order applies. Deviating terms of the customer apply only if we agree to them in writing.
2. Offer and conclusion of contract
The presentation of products in the shop is not a binding offer but an invitation to order. By clicking "Place order" you make a binding offer. We confirm receipt by email; the purchase contract is concluded with this order confirmation or, at the latest, when the goods are dispatched.
We may decline an order, for example if an item is no longer available or there is an obvious pricing or typing error. In that case we refund any amount already paid immediately.
3. Prices
All prices are in Swiss francs (CHF) and include any statutory VAT. Shipping costs are shown separately during checkout before you place the order. The price at the time of the order applies.
4. Payment
The payment methods shown at checkout are available. Payments are processed by our payment provider Stripe; the charge is made when the order is placed. Vouchers and discount codes cannot be redeemed for cash and can only be applied before the order is placed.
5. Delivery
We deliver only to addresses in Switzerland. Shipping methods, costs and delivery times are listed under Shipping & returns. Delivery times are indicative.
If an item cannot be delivered we will inform you promptly. You may then withdraw from the contract and we will refund any amount already paid.
6. Transfer of risk
Benefit and risk pass to you when the goods are handed over to you or to the authorised recipient you named. Please report visible transport damage directly to the carrier and inform us by email within 5 days.
7. Retention of title
The goods remain the property of Mahwear until paid in full.
8. Returns (voluntary right of return)
Swiss law provides no statutory right of withdrawal for online purchases. We nevertheless offer a voluntary 30-day right of return from receipt of the goods:
- The goods must be unworn, undamaged and in the original box. Please try shoes on indoors on a clean floor.
- Announce the return by email to Fatemehtjk99@gmail.com or in your customer account.
- We refund the purchase price to the original payment method within 5 working days of receiving and checking the return. The original shipping costs and the cost of the return are not refunded unless the goods are defective or were delivered incorrectly.
- Direct exchanges are not possible. Please return the item and order the desired size again.
If returned goods show signs of use, we may refuse the return or deduct a reasonable amount for the loss in value.
9. Warranty
The statutory warranty provisions of the Swiss Code of Obligations apply (Art. 197 et seq. CO). For new goods bought for personal or family use, the warranty period is two years from delivery.
Please inspect the goods on receipt and report defects as soon as possible after discovering them, by email to Fatemehtjk99@gmail.com, ideally with photos and the order number. For justified defects we will, at our discretion, provide a replacement or refund the purchase price; your other statutory rights remain reserved.
Normal wear and tear and damage caused by improper use, incorrect care or alterations to the goods are not defects.
10. Liability
We are liable under the statutory provisions for damage caused intentionally or through gross negligence. Liability for slight negligence and for indirect and consequential damage is excluded to the extent permitted by law. Mandatory liability provisions, in particular under the Product Liability Act and for personal injury, remain reserved.
11. Customer account
You are responsible for keeping your password confidential. We may block accounts that are misused.
12. Data protection
How we process your personal data is explained in our privacy policy.
13. Governing law and jurisdiction
Swiss law applies exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction is Zollikofen or the competent court in the Canton of Bern. Consumers may also bring proceedings at their place of residence and can only be sued there (Art. 32 Swiss Civil Procedure Code).
14. Final provisions
Should any provision of these terms be invalid, the remaining provisions remain in force. We may amend these terms at any time; your order is governed by the version in force when you placed it.
